Terms of Service

1. Acceptance of terms

By accessing or using Peak Beak services, websites, or products, you agree to comply with and be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

2. Description of service

Peak Beak provides tailored web design, managed hosting, and business automation solutions. Services are provided "as described" in the plan selected at the time of purchase.

3. Hosting & acceptable use

Clients using hosting services must not use Peak Beak resources for unlawful activities, including malware distribution, copyright infringement, or unauthorized mass emailing (spam).

4. Billing & subscriptions

Monthly website plans are billed on a recurring basis with a 24-month minimum term. Failure to maintain an active payment method may result in service suspension. One-time build fees are billed as per the project agreement.

5. Referral account credits

Active Peak Beak clients may be eligible for a $100 account credit for each qualifying new client they refer.

To qualify, the referred business must mention the referring client before or during the sales process, must be new to Peak Beak, and must either go under contract and pay for a one-time website build or go under contract for a monthly website plan. The referral credit is applied to the referring client's Peak Beak account after the referred client has satisfied those requirements.

Referral credits are account credits only, have no cash value, are not transferable, and may be applied toward eligible Peak Beak invoices or services at Peak Beak's discretion. Credits cannot be used to reduce amounts already paid, cannot be combined with another referral claim for the same referred client, and may be adjusted or discontinued for future referrals at any time.

6. Content & ownership

Upon final payment, clients own the specific visual content of their website. Peak Beak retains rights to underlying proprietary code or frameworks used across multiple client builds.

7. Uptime & maintenance

Peak Beak strives to maintain high uptime and reliable performance. Routine maintenance is scheduled outside of your visitors' typical browsing hours wherever possible, using site analytics to identify low-traffic windows. While we work hard to keep your site fast and available, uptime is not guaranteed, and Peak Beak is not liable for indirect or consequential damages resulting from data loss or service interruptions beyond our control.

8. Governing law

These terms shall be governed and construed in accordance with the laws of the operating jurisdiction of Peak Beak Hosting Solutions.
